| 摘 要： | 未成年人的监护问题纳入公权监督，不仅是我国履行国际法义务的外在要求，而且是弥补监护缺位，社会监督失灵，保护未成年人合法权利的本体需求，既要私权自治又要适当国家干预，符合公权监督私权的法理要求。因此，应当设置检察官走访制、出具报告制、诉讼辅助人和设立强制举报制度等一系列监督法律制度，做到事前预防和事后法律救济。只有这样，才能明确责任主体，多层次、多角度地构建未成年人人权保障监督机制。
