| 摘 要： | 通过立法整合各种相互冲突的法律价值,来确保来自常规行政的预防以及来自紧急行政的应急处理的理性化;通过对来自官僚主义的不良表现、政府预警管理的内在张力和政府预警机制法理框架等方面的法理分析,采取对公民权益减损程度最小化的方式,来最有效地防治突发公共事件,使之不再因政府的防范不力而那么频繁地发生;即使发生了,也不至于因紧急行政的应急处理不力而变得那么可怕。正是在这个意义上,来自立法的贡献变得不言自明。

| Abstract: | By legislating to conform all kinds of conflicting law values,in order to ensure routine administrative precaution and rationalization of administrative emergency treating.By analyzing bureaucratese's bad expression,inherent tension of government forewarning administration and law frame of government forewarning mechanism and so on form theory of law,in order to prevent and cure the public sudden incident with a manner which detract the smallest interests form citizens,to make it free form government's out of precaution and make its occurrence much less.Even if it happens,it will not cause great damage.Just form this point of view,it goes without saying that contribution from legislation great. |
