弱势群体保护法律问题研究——基于经济法与社会法的考察视角

弱势群体的保护需要法律制度的支撑。本文从法律的角度对弱势群体的概念做了界定,指出了社会对弱势群体应有的正确认识和法律制度设计必须树立的几个基本理念,讨论了弱势群体法律保护的原则,提出了以社会法建立弱势群体保障性法律保护制度和以经济法构造弱势群体发展性法律保护制度的构想。

A Study on Legal Issues in the Weak Groups''''Protection

It is necessary that the law and regulations to protect social vulnerable groups. This paper, from the point of the view of law, defines the concept of social vulnerable groups, points out the proper attitude to social vulnerable groups as well as the idea of law which protects the social vulnerable groups, and discussed the principle of law protected the social vulnerable groups. In the end, the author constructed the system of law and regulations protected the social vulnerable groups, which was constituted by two parts, security system of law and development system of law, the former made up by social law, the latter made up by economical law.
