| Abstract: | Whether the right of real claim is an independent right of claim separated from the obligatory right depends on positive analysis of the related pros and cons, but not on the logic reasoning. The right of real claim should be independent of obligatory system and the related stipulations of the Proposal Draft of China Real Right Law should be improved. |
