| 摘 要： | 当前我国存在着代位权制度与代位执行制度。有学者提出代位权制度并无存在之必要 ,建议以代位执行制度取而代之。从现实看 ,两种制度各有优缺 ,对二者进行整合使之衔接协调 ,将更能发挥其调整债权关系之作用。

| Abstract: | Both the two systems of subrogation right and subrogation performance exist in China. Some scholars suggest the unnecessity of the former and its being replaced by the latter. But practically speaking, both of them have their own advantages and disadvantages. The linkup and coordination of both can exert their function of regulating the credit relationship. |
