日本检察制度简介（上）

日本在历史上曾效仿中国的法律制度,设置了类似于现代意义上的检察制度的制度.明治初期曾引进法国的检察制度,明治中期以德国法为蓝本改革检察制度,二战后又受到美国的影响,最终建立了颇具日本特色的现代检察制度.日本现代检察制度下的检察权包括对犯罪进行侦查、对刑事案件实行公诉、请求法院正当适用法律、指挥和监督裁判的执行、对属于法院权限的其他事项要求法院通知或向法院陈述意见以及作为公益代表人处理依其他按照法令属于其权限的事务等多项权限.
