论中国青少年法律与司法特别保护

我国在青少年特别保护方面积累了丰富经验,但仍然存在很多严重问题,主要表现为法制观念滞后、相应的法律制度存在结构性缺陷、保障机制不完备、司法环境不完善、与国际标准有较大差距等。应当进一步理论创新,构建以青少年法律与司法特别保护制度为核心的新青少年法学,同时还应当对青少年特别保护政策、最低标准、保护原则、具体制度和独立程序等进行较大幅度的调整和完善。

A study in the problems of the Chinese youth and juvenile laws and the special judicial protection and their countermeasures

Despite a lot of experiences in special protection of youth and juveniles, China is still facing many serious problems in this field. The problems can be elaborated as delay in legal concept, structural drawbacks in the legal system concerned, unsatisfactory institution of protection, unbeneficial judicial environment, and relatively large gap between the Chinese standard and the international one. All of these factors necessitate furthering theoretical innovation and outlining a new science of law for youth and juveniles centered on the youth laws and judicially special protection system. Meanwhile, a substantial adjustment and consummation of the special protection policies, minimum standard, protective principle, individual institution, and independent procedure is also demanded strongly.
