执行异议之诉与破产程序衔接法律问题研究

被执行人进入破产程序后正在审理的执行异议之诉应该如何处理的问题,因受相关立法对执行异议之诉与破产程序衔接缺乏具体规定、法院裁判理念及管辖存在争议等多种因素影响,导致不同法院的裁判结果存在较大差异。一方面,破产程序的启动并不必然导致执行程序的终结;另一方面,执行异议之诉的裁判对界定债务人财产范围具有证明效力,执行异议之诉的审理并不因破产程序启动而必然终止。在加强与破产案件审判协调的基础上,应根据破产程序所处不同阶段、当事人的诉讼请求及执行异议之诉起诉主体等因素,对执行异议之诉予以分别处理。

Research on the legal issues concerning the connection betweendissent action of execution and bankruptcy procedure

On the issue of how to deal with the dissent action of execution that is being heard after the person subject to enforcement enters the bankruptcy procedure,due to the lack of specific provisions on the connection between the dissent action of execution and the bankruptcy procedure under the relevant legislation,and the court’s judgment concept and jurisdiction disputes,etc.the judgment results are different in different courts.On the one hand,the initiation of the bankruptcy proceedings does not necessarily lead to the termination of the enforcement proceedings;on the other hand,the judgment of the dissent action of execution has the certifying effect in defining the scope of the debtor’s property,and the hearing of the dissent action of execution does not necessarily terminate due to the initiation of the bankruptcy proceedings.On the basis of strengthening trial coordination with bankruptcy cases,dissent action of execution should be handled separately according to factors such as the different stages of the bankruptcy proceedings,the litigants’claims and the subject of the dissent action of execution.
