中国检察权建构模式下的实践形态反思

关于我国检察权的性质存在多种学说,将其定位于法律监督权属于目前较为统一的看法。在我国的权力建构模式下,检察权若作为法律监督权,在规范层面,将面临很多法律层面的缺位情况。在实际运行层面,则存在着法律监督被放置于刑事诉讼监督、行政机关掌控检察机关的资源、检察权宪法权能与法律权能运行不协调、公诉权是否属于法律监督权等解释难题。

Reflection on the Practice Patterns under the Construction Mode of Chinese Procuratorial Power

There are several theories about the nature of the procuratorial power of our country,and it is a more consistent view to define it as legal supervision.Under the construction mode of Chinese procuratorial power,if the procuratorial power is regarded as legal supervision,it will be faced with the absence of legal aspects at the normative level.And in actual operation level,there are many problems： legal supervision was placed on the supervision of the criminal proceedings;administrative organs control the resources of prosecution;the constitutional power of prosecutorial power is not consistent with its legal empowerment;public right is within legal supervision or not,etc.
