| 摘 要： | 不可量物侵入制度肇始于罗马法,时至今日已成为世界各国与地区立法通例,但在具体形式上则因发展差异与认识各异、历史沿革不同而致含义、外延立法各异。有效研究和借鉴各国立法经验,可为我国今后司法裁判及法律修订提供理论上的支持。
