| 摘 要： | 量刑建议制度是指检察机关在提起公诉或出庭支持公诉活动过程中,根据法律规定和案件的事实和情节,就被告人的量刑问题向法院提出具体意见的一种制度。量刑建议制度的实行,对保证量刑公正、节约司法资源是非常必要的。然而,量刑建议相关制度的滞后也阻碍了量刑建议的推广。

| Abstract: | Sentencing suggestion system is the system that procuratorate organs submit opinion to courts on sentencing problem based on the law and fact during the prosecution proceeding.Sentencing suggestion system will ensure sentencing fairness and save judicial resource.However,the lagging of this system sets back the broadcasting of sentencing suggestion. |
