渎职犯罪结构性立法缺陷及对策

历经几次刑法修正和司法解释,我国渎职犯罪刑事立法有了长足进步,但在结构排序、罪名设置、法条逻辑、量刑标准等方面仍存在一定的缺陷,在一定程度上造成理论上的矛盾和混乱,并在司法实践中给渎职罪的认定和处理带来一定的困难。文章兼顾理论和实践,对我国现行渎职犯罪立法结构存在的缺陷进行了分析并提出对策。

Defects and Countermeasures of Structural Legislation for Malfeasance

The criminal legislation of malfeasance has made great progress in our country after several criminal amendments and judicial interpretations,but there are some defects in the order of structure,setting of charges,logic of laws,and standard of sentencing,which have caused some contradictions and confusion in the theory to a certain extent and brought some difficulties in identifying and treating malfeasance in judicial practice.The article analyzes the defects of structural legislation for malfeasance and then gives some countermeasures through both theory and practice.
