| 摘 要： | 仲裁协议是仲裁制度的基石,对仲裁协议效力的确认直接影响到仲裁程序的运行。我国《仲裁法》中仲裁协议效力确认制度存在仲裁协议形式要求过于僵硬,实质要件要求过于严格等问题,应放宽仲裁协议的形式要求,完善仲裁协议的实质要件。

| Abstract: | Arbitration agreement is the base of arbitration system.The agreement confirmation impacts the operation of arbitration proceeding directly.The arbitration system regulated in arbitration law is not flexible,and substance conditions are strict.To improve this system,the form conditions should be loosening,and substance conditions of agreement should be changed. |
