| 摘 要： | 受传统文化的影响，婚约在我国民间有着强大的生命力，现行立法回避了婚约问题，使大量婚约纠纷无法解决。事实上，人们订立婚约，是一种民族传统习惯，而且婚约自身也具有许多功能因素。本文从婚约立法规制的必要性、婚约的性质、效力、婚约解除、无效和撤销及其法律后果等方面论述婚约制度，同时提出建立我国婚约制度的立法构想。

| Abstract: | Influenced by the tradition,culture wedding engagement has lived actively in the folk of my country.However,the current law do not involve it,Thus,a lot of conflicts can not be solved successfully.In fact,making wedding engagement is a traditional habite of the nation,and the wedding engagement itself has many functional factors.The paper mainly focuses on the necessity of making the law on wedding engagement.the nature and effect of it.the releasing of wedding engagement and its legal consequences.etc.meanwhile,set forward the proposal of establishing the criteria of wedding engagement in our country. |
