| 摘 要： | 我国《监狱法》对释放制度的规定过于简略,必须加以完善。有必要比较我国历史上和我国澳门、台湾等地区以及国外的监狱法律法规关于释放的规定,进一步研究释放之依据、释放时间、释放时病犯之处理、释放后的安置及程序等。

| Abstract: | Our country's prison law is very simple about release system,so it must be perfected.On the basis of comparing with our country's historical prison laws and prison laws in Macao,Taiwan,and foreign country as well as rules about release system,this article supplies some suggestions to perfect the basis of release,time of release,treatment of ill prisoners when be released,arrangement after release and procedure of release. |
