| 摘 要： | 构成无限防卫必须是防卫的起因、时机、对象、主观等“四要件”的齐备,否则,便属于不饱和无限防卫,即不具备或不完 全具备无限防卫构成要件的情形。这种情形具体包括:起因要件之欠缺,假想无限防卫;时机要件之欠缺,无限防卫不适时;主观要件 之欠缺,互相斗殴、挑拨无限防卫、偶然无限防卫;对象要件之欠缺,防卫无辜第三者。

| Abstract: | The unlimited defense must include four componential essentials:causal ,occasion, object, subjectivity, otherwise, it falls into unsaturated unlimited defense . It is the situation under which the componential essentials of the unlimited defense are not provided with or are not fully provided with. To be specific, it refers to the deficiency of the causal essential, that is, hypothetical unlimited defense; the deficiency of the occasion essential, that is, untimely unlimited defense; the deficiency of the subjectivity essential, that is, mutual fight, provocation of the unlimited defense, the incidental unlimited defense; the deficiency of the object essential, that is, the unlimited defense towards the innocent third party. |
