| 摘 要： | 《刑法》第360条第一款将卖淫者与嫖娼者同等视之并予以同样惩治是不合理和违反人道的。在目前无法全面禁娼的国情下，对嫖娼者在强制其履行安全性行为的同时还要给予打击，而对卖淫者在处罚的同时，给予更多的人文关怀。对性病的预防和控制要多采取一些关爱体谅的措施，并以性工作者自愿、自觉参与为度。

| Abstract: | It is unreasonable and anti-humane that Penal Law 360(1),doesn't separate prostitutes from whoremasters and give them the same penalty.Police has too strong power of punishing prostitute and whore-master,which is no under supervision by effective regimes.It is reasonable and lawful for whoremasters to enforce them the obligation to do safety-sexual-conduct.on the other hand,gradually to give them serious punishment.Because now China government has big difficulty in controlling prostitute and whoremaster,it ... |
