| 摘 要： | 随着动物保护呼声的高涨和《德国民法典》第90a条“动物不是物”的规定，动物的法律地位问题日益凸显并在国内法学界引起广泛争论。通过对这一争论呈现的焦点问题之盘查，笔者试图探究这一问题的实质，进而总结这一争论的意义。

| Abstract: | With the increasing of the voice of the animal protection and the 90a's rule of "animal isn't object" in German Civil Law Code,research on the animal's legal status is becoming more and more important,and debated greatly in the research field.Through observing the focus of the dispute,authors pay much attention to the essence of the dispute,generalizes the role of the dispute. |
