犯罪构成理论的梳理及构建理念的反思

犯罪构成理论兼具法律属性和理论属性,两者不可偏废。文章通过对传统犯罪构成理论与修正犯罪构成理论的梳理,试图发现隐藏在犯罪构成理论背后的基本理念,经过分析总结后指出,无论犯罪构成如何建构,终归是总量不变(构成要件要素数量一样),能量守恒(实现定罪功能),并进一步认为,无论什么样的犯罪构成都必须遵循先客观后主观、先形式后实质、先事实后价值的基本理念,否则这个犯罪构成理论就不科学。

Tiding the System of Crime Constitution and Rethinking the Construction Idea

The system of crime constitution has both law and theory nature ,no one can be given up.Based on the traditional and the new-style crime constitution theory, trying to find the fundamental idea behind the crime constitution theory.After analysis and summary, referring to no matter how construct the crime constitution, there are always ＂a same totle （the amount of constitutive elements are same）, a same effect（Conviction of function）＂, then furtherly thinking, all kinds of crime constitution must comply with the following principles, named objective first and subjective after, form first and substance after, fact first and value after.
