论权衡方法在行政法适用中的展开

On the Balancing Method in the Application of Administrative Law

The judgement by Administrative Law has an obvious nature of balancing of interests . In a concrete case,for legitimate and effective balancing we need to develop a method which has its own self—consistent system of propositions and theoretical basis. Taking the Judgment of the abuse of power as an example,we can deeply understand steps,order and considerations in the application of the balacing method which aims to realise a right and appropriate judgement. Meanwhile,we also need to reconsider the defects or problems in the balacing method.
