驰名商标法律保护中的若干问题探讨

在驰名商标的认定标准上 ,应明确界定“相关公众”为“本国相关公众” ,不应仅限于注册商标 ,认定标准需要进一步量化 ,在认定方式上 ,应改变目前单一的行政认定方式 ,采取行政认定和司法认定的“双轨认定”模式 ,并应以商标局的事前认定为主 ,法院的事后认定为辅 ,加强并完善驰名商标的反淡化保护。

On Issues of Legal Protection To Well- Known Trademarks

Of the identification standard of well-known trademarks,"relative public"and "native relative public"should be explicitly defined.Both the registered trademarks and the identifying norms need to be specified.While the present identification approach of government domination should be replaced by the "dual identifying"model of both government and judicial involvement,the pre- identification of the trademark bureau should be supplemented by the post-identification of the court.Additionally,the anti-delution protection of these trademarks is expected to be strengthened and perfected.
