| 摘 要： | 情事变更制度曾是《合同法》起草过程中争议颇大的一个问题。最后出台的《合同法》(1 999年 3月 1 5日第九届全国人民代表大会第一次会议通过 )没有规定该制度。虽然社会情事的巨大变化或灾变是非常规情形 ,但是现实生活中情事变更毕竟会时有发生。因此 ,在司法实践中 ,运用情事变更制度审判案件是不可避免的 ,规范这一制度也是势在必行

| Abstract: | The institution of affair alteration once was the most disputed issue during the afting. The ppearedpublicly latest (passed in ninth National people's congress on Mar 15th 1999) did not prescribe it. Although the huge alteration of social affair or disaster is not the conventional situation, the affair alteration will occur sometimes in the realistic life. And it is inescapable to use the institution of affair alteration during the juridical practice, so it is imperative under the situation to prescribe the institution of affair alteration. |
