风险社会下的责任主义

20世纪以来，随着风险成为现代社会的重要特征，刑法理论和实践也面临着严峻的挑战。责任主义是刑法中的一项重要原则，包含着报应主义与功利主义两种刑罚价值的制衡。为了防范风险维护公共安全，责任主义需要对两种价值选择进行新的定位。作者从归责上的责任主义，量刑上的责任主义以及团体责任三个方面，分析责任主义在风险社会下可能出现的变化。

Responsibiligy in Risk Society

Since the 20 century, risk has been an important characteristic of modem society and criminal theory and practice have been facing austere challenge. Responsibility is a main principle in criminal law, including the balance of retributivism and utilitarianism. Responsibility need make new orientation between these two merits, in the interest of protecting us from risk. This thesis analyses the possible changes of responsibility through three aspects, imputation, sentence and corporate obligation. This maybe manifests the response to risk society from the criminal law.
