侦审体制改革以来我国侦查预审制度调整与运行状况的考察

1997年侦审体制改革后,预审制度规则体系出现重大调整伴随预审名称、组织、工作程序、具体职能的变化,预审运行机制也发生了显著改变:预审原来承担的大部分侦查职责被归还于侦查人员,而以审查、核实侦查案卷证据、批准、决定报请逮捕、移送起诉为主要内容。但在目前行政化的侦查体制框架下,预审权力位于阶梯式权力结构的基层,预审程序也更加封闭,甚至被法制部门的行政性审批所同化作为一种内部监督机制,现行预审与现代预审制度着重防范、控制强大的侦查权过于自由裁量的要求有较大差距,而这是我国预审制度完成现代化转型必须面对和克服的重要问题。
