论犯罪圈扩张的正当性--以晚近我国刑事立法和司法解释为基础的分析

犯罪化与犯罪圈不是等同的概念。犯罪圈的扩张说明犯罪化在我国刑事立法中是占据主导地位的。犯罪圈的扩张是刑法结构转变的必然要求,是劳动教养退出历史舞台后弥补处罚漏洞的必要举措,符合强化刑法对法益保护的客观需要,是刑法获得国民认同、提升民众规范意识的必要途径。在《刑法修正案(九)》颁行之后,司法解释对贪污受贿犯罪入罪门槛的提高,是对我国犯罪圈扩张趋势的背离。

On the Justification of the Expansion of Criminal Circle--Based on the Recent Criminal Legislation and Judicial Interpretation in China

Criminalization and criminal circle are not equivalent concepts. The expansion of criminal circle shows that criminalization is in the dominant place in China’s criminal legislation. It is an inevitable requirement which results from the change of the structure of criminal law,an essential measure to make up for punishment loopholes after the re-education through laboris abolished,an objective requirement of strengthening the protection of legal interests by criminal law,and a necessary way to acquire the national recognition on criminal law and enhance the people’s standard consciousness. After the implementation of the Amendment to the Criminal Law (Ⅸ),the threshold for the conviction of the crimes of embezzlement and bribery brought by the judicial interpretation is increased,which depart from the expansion trend of criminal circle in China.
