| 摘 要： | 当前我国保险法制建设中存在的突出问题,一方面相对集中于<保险法>,另一方面表现在保险法律适用的辅助机制没有建立和保险法律实务研究的缺位,而司法领域对保险法律的研究却走到了保险业的前列.为保障和促进保险业的稳健、快速发展,必须在修改、完善<保险法>的同时,进一步加强<保险法>适用的研究,尽快建立保险法律适用的辅助机制,建立和健全保险公司总法律顾问制度,强化保险公司保险业务经营的法律意识,尝试建立保险纠纷案件的协商、调解机制,减少保险诉讼案件对保险消费者的负面影响.

| Abstract: | The problem of our insurance legal system exists in the Insurance Law of the People's Republic of China and the lack of assistant mechanism of the insurance law of application.It is necessary to amend the Insurance Law of the People's Republic of China,strengthen the research of the insurance law of application and establish the assistant mechanism of the insurance law of application with a view to protecting and promoting the healthy development of the insurance business. |
