个别预防与矫正关系辨析——兼论职务犯矫正目标的设定

我国刑法学关于个别预防的理论还存在很大的争议,这与个别预防概念界定的不科学有关.使用“矫正”一词来替代“改造”更符合逻辑,便于将“社区矫正”和“监禁矫正”统一起来.个别预防与矫正在哲学依据、适用对象、基本目标等方面有相同之处,但两者也存在一些差别.职务犯矫正目标的设定应适当高于普通罪犯.

Analysis of the Relationship between Individual Prevention and Correction

The disputes about theories of individual prevention are arisen by the inaccurate definition of individual prevention in the criminal law circle in our country.It would be more logical to substitute correction for reformation and to unify community correction with imprisonment correction.There are several similarities between Individual prevention and correction,such as philosophical basis,applied object and basic goal.But there are some differences between them.The correctional goal we set up for the public official criminals should be higher than that of the regular criminals.
