驰名商标异化的法律规制

驰名商标异化为我国独有的一种社会现象。导致驰名商标异化的原因有多种因素,但其后果则是背离了设立驰名商标保护制度的立法初衷,同时,危及到了商标保护的正当性。尽管最高人民法院已出台了相关的司法解释,以阻止驰名商标异化的加剧,但孤掌难鸣,还需要行政部门和相关立法的配合,以从根本上遏制驰名商标进一步异化,从而回归驰名商标制度的本质意义。
