| 摘 要： | 破产民事责任是指企业法人高管及其相关人员对违反破产法规定的义务，导致企业破产或损害破产债权人利益的行为应当承担的民事法律后果。破产管理人作为诉讼相对人。民事责任赔偿金应当纳入破产财产统一分配。

| Abstract: | Civil liabilities in bankruptcy is a kind of legal effect in Civil Law, which the senior officers and the interrelated persons in enterprises should assume when they violate the duties stipulated in Bankruptcy Law, and directly result in bankruptcy of enterprises or damage the interests of creditor because of it. Administer in bankruptcy should be an independent party in civil litigation. Penalties in civil liability should be a part of properties in bankruptcy and distributed uniformly. |
