| 摘 要： | 本文讨论的精神伤害刑事行为及精神损害赔偿是我国刑事立法和刑事法学的一项新课题。作者从它的历史沿革入手 ,阐释了刑事上精神损害概念是一个不断发展和丰富的法律范畴 ;补说了精神伤害罪的构成原理和处理精神伤害赔偿的法律技术 ;辩正了刑事精神损害赔偿和附带精神损害赔偿的不同特点。针对我国刑事立法的缺陷 ,借鉴国外先进的立法例 ,提出了惩治精神伤害刑事行为和民事赔偿的立法构想。

| Abstract: | Mental hurting and corresponding compensation discussed in this article are new topics in both crime legislation and crime law science. The author thinks the concept of criminal action of mental hurting is developing and enriching. The author also points out the structural principles of criminal action of mental hurting. What's more, the article discusses the difference between compensation of mental hurting and attached compensation of mental hurting. |
