| 摘 要： | 滥用职权罪的罪过形式一直是刑法理论界争论的焦点,但到目前为止尚没有一种学说取得通说地位.滥用职权罪是一种典型的渎职犯罪,在对学界几种典型观点批判与借鉴的基础上,作者从复杂罪过入手,以危害结果和犯罪客体为分析工具,把罪过认识中的"危害社会的结果"理解为"对犯罪直接客体中的主要客体的侵害结果或状态",并将其中争议颇大的"重大损失"的地位界定为一种"结果化的严重情节",进而得出滥用职权罪的罪过形式是故意的结论.最后提出了立法中如何避免出现复杂罪过现象的几点建议.
