| Abstract: | Being humanity - oriented, the theory of anticipated probability displays relevant rationality as it is in agreement with the modesty - and - restraint principle in the criminal law. It will play a positive role in our current criminal justice if we introduce the rational essence of the theory into our legal framework and it will be of great significance at a time when China is carrying out the new criminal policy of tempering justice with mercy in order to build a harmonious society in an all - round way. |
