论法律职业者之正义

尽管正义问题 ,已经得到了哲学 (伦理学 )、社会学、法理学、诉讼法学等不同学科的大量论述 ,但是 ,这些论述无法成为法律职业者在其执业领域的具体行为规则 ,法律职业的特殊性决定了法律职业者的正义与普通公民的正义必定存在着差异 ,而正义一词语义不确定的情况导致对法律职业者的评价缺乏客观统一标准 ,对此学界关注的不多。提出法律职业之正义的执业标准和具体伦理要求 ,对于弥补职业道德规范之不足、帮助法律职业者进行自我监督、评价和调整以及深入进行法律职业伦理的研究等 ,都具有重要意义。

On Justice of Legal Professionals

Justice has been considerably elaborated in various subjects such as philosophy,sociology,jurispudence,procedural law. Such elaborations,however,cannot make specific rules of conduct complied with by legal professionals in their practice . The specialty of legal profession has decided the differences in justice between the professionals and the average citizens . The absence of its definition may lead to the lake of uniform criteria of assessment ,which is neglected by the legal cirle. Because of this, it's of great significance to have practicing criteria and specific ethical reguirements in order to complement the professional ethical regulation, help the professionals supervise, assess and adjust themselves,and make research on legal professional ethics .
