| 摘 要： | 转化型抢劫是指实施盗窃、诈骗、抢夺、聚众“打砸抢”等行为过程中 ,具备法定的情形 ,而以抢劫罪论处的犯罪。由于此种犯罪并非典型意义上的抢劫罪 ,而我国刑法又把这种犯罪以抢劫罪论处 ,所以我国刑法对转化型抢劫的规定与其所确立的“罪刑法定”原则和“罪刑相适应”原则发生了冲突且司法实践中出现的一些情况正好反映了这种冲突的存在

| Abstract: | The transformed robbery,which is took as robbery,refers to the offense with legal circumstances in the course of carrying on stealth,fraud,robbery,and massive beat_smash_loot,etc.However,it is not typical robbery,which is accepted as robbery in our country.As a result,this stipulation comes in conflict with the principle of "a legally prescribed punishment for a specified crime" and "suiting punishment to crime",which is reflected in the judicial practice. |
