宪法在民事诉讼中的适用

在我国,长期以来,仅仅从理论上肯定了宪法的最高法地位,而在司法实践和人们的社会生活中,宪法并没有得到足够的重视,宪法更像是一个挡箭牌在必要的时候拿出来唬唬人。而今随着我国法制化步伐的加快,宪法的最高法地位必须得到应有的重视。本文着重从理论上探讨了宪法与民事诉讼的关系和宪法在民事诉讼中的适用空间,并且收集了一些典型案例来说明宪法已经运用到了民事诉讼中,当然这种适用还存在许多无奈,尽管这样,我还是对将来我国宪法的司法适用性抱有非常乐观的态度。

The Serviceability of a constitution in Civil Actions

In China,since long ago,the constitution is committed as a highest method status only based on a theory,but not paid more attention to in judical practice and socical life.It is mostly like ashield used in necessity to frightened the person.But now,as the process of chinese legal system is fastened,the highest method status of the constitution must be paid attention to as it should preserve.This article mainly aralyzes the relationship between the constitution and civil actions and the suitabie room of the constitution in civil actions.In anddition,there are some typical cases used to indicate that the constitution has already been used in civil actions.Of course,although this serviceability has many unsatisfied aspects as people see,we should have the optimistic attitude to the future of the judical serviceability of the chinese constitution.
