论行政立法的程序控制

行政立法在我国立法体制中的地位和作用越来越重要,但是也存在突出的问题,如侵害国家立法权等。然而实体上的事后控制难以弥补违法立法对社会造成的损害,加强行政程序立法的研究,对行政立法进行程序控制,是保证立法质量和提高立法民主化的重要途径。

On the Proceeding Control of Administrative Legislation

The administrative legislation has played a greater role in the functions of our state,but there are some outstanding problems such as infringing upon the legislative power of the state,founding license arbitrarily,lacking proceeding legislation and so on.The substantive subsequent control is difficult to remedy the damages caused by infraction or improper legislation.Strengthening the research on the administrative procedural legislation and controlling the procedure of the administrative legislation will be an important means to guarantee the legislative quality and improve the legislative democratization.
