行政合同中的价值悖论与释然

行政合同是在近现代民主思想的影响下产生发展起来的一种较柔性的行政管理方式，它是权力因素和契约因素相结合的产物。行政合同中所体现的权力和契约的双重性造成了对其传统认识上的价值悖论，但是这两种价值并非根本对立冲突，而是可以互补相融的，形成一定悖论程度中的释然。
