受贿罪问题探讨

受贿罪是我国目前多发而且社会危害性非常严重的犯罪之一。在分析了国内和国外相关法律规定和学者观点的基础上,认为受贿罪侵犯的犯罪客体是国家工作人员职务的廉洁性,犯罪对象为多种利益,既包括财产、财产性利益,也包括非财产性利益。在此基础上,作者还认为性贿赂也可以成为受贿罪的犯罪对象,因为性贿赂与普通的财物相比具有更严重的社会危害性,无论是国内立法还是国外刑法理论和法律规定都有类似规定,认定性贿赂为受贿罪的内容符合我国立法本意。受贿罪的犯罪主体为国家工作人员。除此之外,离退休的国家工作人员因为存在着"职务上的便利条件",也可以成为该罪主体,符合司法实践和我国刑法理论,也与我国国情相适应。

The article is on the basis of analyzing domestically with relevant legal provisions and scholar's view in foreign countries, think that the object of crime that the acceptance of bribes infringes is the honesty of the national staff member's post, crime target many kinds of interests, includes property, property interests, it includes to be property nature interests too. On this basis, author person who think bribery may become crime target of acceptance of bribes too also, because compared with ordinary property the sex bribery has more serious social harmfulness, both internal legislation and foreign criminal law theory and legal provisions all have similar regulations, the asserting bribery accords with the legislative original idea of our country for the content of the acceptance of bribes. The subject of crime of the acceptance of bribes is a national staff member. In addition, have "facility of post "from pensioner national staff members,can become this crime subject too, accord with administration of justice practicing and criminal law theory of our country, in conformity with national conditions of our country too.
