“产品责任”概念反思

在研究＂产品责任＂制度时,应厘清＂产品＂和＂产品责任＂之概念和内涵。纵观国际上该项制度和我国对此规制的缺陷,应对其内容合理拓展,但＂产品＂一词或大或小,在涵盖该制度内容时已经陷入了两难困境,只有采用＂商品＂一词才恰如其分。同样,＂产品责任＂的理论根据并没证明自己,反而证伪了自身,只有＂经营者侵权责任＂才能证明该项制度的内涵。因此,应用＂商品＂和＂经营者侵权责任＂分别替代＂产品＂和＂产品责任＂。

The Nirvana and the New Life of "Product Liability"

In the research "product liability" legal system,we should first clarify the "product" and "product liability" concept and contents.Taking a panoramic view of the international system and China’s regulatory system defects,its content should be a reasonable expansion.But the term "product",large or small,to cover the contents of the system has entered an impasse,only by adopting the word "commodity" was fitting.Similarly,the "product liability" theory did not prove himself under,but proves falsification of itself,only "operators tort liability" in order to prove that this system connotations.It is my suggestion to use "commodity" and "operator tort liability" substituted for "product" and "product liability.
