| 摘 要： | 以劳动法治为视域展开的分析与建构,已经成为劳动刑法研究的全新思路和有效实践,这是劳动刑法跻身于现代刑法之列、彰显其重要功能、明确其罪责模式以及揭示其本质的学术生长点的重要促动因素。在劳动法治视域下,劳动刑法研究不仅试图重新考虑刑法介入劳资关系的边界与模式,求证劳动刑法制度创生的法理基础,而且它更想让人类从一个全新视角来理解劳动刑法制度的形成、功能及罪责结构,进而认识中国劳动刑法制度创生的内在机理。
