| 摘 要： | 国内学者在制度层面对陪审制的探讨已经很多,但对陪审制的价值基础却很少论及.试图对陪审制的价值基础作一个初步的探讨.陪审制作为一种制度,只有对其价值基础有充分的了解才能产生比较深刻的认识.陪审制度主要具有民主、自由、正义和理性等方面的价值,就这四大价值分别予以了详细阐述.

| Abstract: | Many chinese scholars talk about Jury as a part of the legal system,but the value of Jury system is rarely discussed.The text will try to discuss elementary the value of Jury system.As a part of the legal system,if we have not an in-depth study about the value of Jury system,it is difficult to comprehend Jury system.In writer's view,the western system values itself in respect of Democracy,Justice,Liberty and Rationality.The text will study the four sorts of values respectively. |
