| 摘 要： | 因涉嫌一般聚众斗殴而被采取强制措施的犯罪嫌疑人 ,归案后如实供述司法机关尚未掌握的其他由聚众斗殴转化而来的故意伤害、故意杀人罪行 ,应当认定为不同种罪行 ,从而构成自首。
