论司法机关法律文书中的语言运用

语言的运用是法律文书制作过程中最为关键的环节,司法机关对案件事实的分析、认定、适用法律等都要通过语言才能表现出来。由于各种原因,在当今的法律文书制作中,还存在着用词陈旧、个人感情色彩浓厚、表意肤浅、套语过多等弊病,严重影响着法律文书内容的正确表达,所以有必要对法律文书的语言运用予以改进,着力解决适应时代变化、使用普通话、尊重当事人人格、精心选炼词语等方面的问题。

On Language Application of Legal Documents in Judicial Agencies

The usage of languages is the pivotal tache in the execution of writs of law.Judicature department'analysis,recognizance and law application to the case facts are expressed by means of languages.Because of various reasons,a lot of disadvantages,such as antiquated words usages,denseness in personal feelings ,superficialnesses in expressing signification,too much formula,etc.exist in modern execution of writs.All of these disadvantages seriously influence the correct expression of writs of law.Therefore,we should improve the usage of languages in writs of law and exert ourselves to solve the following questions: adapt to the change of times,use common languages,respect party's personality,carefully select the word.
