回族婚姻习惯法的变迁及社会功能研究

回族婚姻习惯法是阿拉伯伊斯兰婚姻制度与中国传统婚姻制度长期相互适应、吸收与交融的产物，回族婚姻习惯法被回族民众普遍接受并成为其婚姻方面的重要准则。回族婚姻习惯法在保持本身特点的同时也随着社会、时代的发展蔼发生变迁，其与国家制定法发生着冲突，也有一定的共性。正确认识婚姻习惯法在当代法治社会中的作用，有利于促进我国《婚姻法》在回族地区的顺利实施，增进民族团结。

Research on Changes and Social Functions of the Hui Marriage and Customary Law

The Hui marriage and customary law is a product of long-term mutual adaptation, absorption and blending of Arab Islamic institution of marriage and the Chinese traditional institution of marriage, which is generally accepted by the Hui people and becomes important criteria for marriage. The Hui marriage and customary law changes with the development of society, while maintaining its own characteristics. It conflicts with the state statutes and has also some commonalities. A correct understanding of the role of the law in contemporary society is conducive to the implementa- tion in the Hui Autonomous Region of China＇ s Marriage Law and national unity.
