检察权独立行使的相对性——兼论列宁关于检察机关垂直领导的思想

检察权的独立行使在列宁时代已被充分强调。检察独立旨在依法公正行使检察权。为此 ,应在维持现行领导体制的前提下推进检察改革 ,改革的任务是围绕维护检察权的相对独立性 ,改革和改善党对检察工作的领导 ,改革妨碍检察权依法独立公正行使的不合理体制 ,并强化地方权力机关对检察权行使的监督。

On Relative Independence of Procuratorial Authority

It was specially stressed in Lenin's time that the procuratorial powers are independently exercised. The independence of public prosecution is aimed to fairly exercise the proocuratorial power. Therefore, on the basis of maintaining the existing leadership system, the reform of public prosecution shall be promoted. Focusing on maintaining the relative independence of the procuratorial powers, the tasks of the reform is to reform and improve the leadership of the Party in the procuratorial area, to reform the unreasonable institutions that hinders the independently exercising procuratorial powers, and to strengthen the supervision of local authorities over the exercise of procuratorial powers.
