| 摘 要： | 孔子和亚里士多德都强调仁爱、友善的德性意义,都主张中庸之道,但二人在治国模式上却衍生出了礼治和法治的不同结论.这在很大程度上影响了中国和西方国家此后数千年国家治理模式的走向.孔子和亚里士多德礼治与法治的分野的实质在于对权力的论证抑或是制约.
