| 摘 要： | 重构中国的外商投资立法体系已成共识，中国加入WTO是其有利的外部因素。WTO协定中TRIMS协议和GATS协议在多边贸易体制中规定了国际投资问题，特别是其规定的国民待遇原则对中国外商投资立法的影响极大。
