| 摘 要： | 经济法是一个新兴的部门法,我国经济法学界在探讨经济法基本原则的构成时,分歧相当大。经济法国家干预经济之法,而市场失灵是国家干预经济的主要原因。从市场失灵的角度,经济法有三大基本原则,即国家适度干预原则、社会整体效益原则和实质公平原则,这三个基本原则间是相互联系、缺一不可的。

| Abstract: | Economic law is a newly emerging sector approach.The constitution of principle rules on economic law exist great differences in economic law.State intervention in economy greatly affected the market failures.From the angel of market failures,economic law is obeyed by three basic rules: national appropriate intervention principle,Social effective overall principle,and the principle of essence of the fair.The relationship of three is inseparable and dispensable. |
