建立与WTO要求相适应的司法审查制度

ＷＴＯ是一个以法律规则为基础的国际组织，其对成员国内司法审查的要求是其高度法律化的典型体现和显著特色。ＷＴＯ有关法律文件对司法审查的要求不尽一致，有关货物贸易和服务贸易的复审或者审查涉及到行政复审、仲裁裁决和司法审查，ＴＲＩＰＳ协议则要求司法审查。我国应当按照ＷＴＯ的要求和中国加入议定书的承诺，维持、建立和完善相应的司法审查制度，并尽快完善相应的司法制度。
