合格法律人才的培养和选拔是中国法治事业的基础,但我国目前的法学教育、司法考试、职前职后培训等制度无论是作为个体还是整体都存在诸多问题。本文以武汉市司法局的司考数据为基础,对司法考试制度进行了全面深入探讨;同时对法学教育、司法研修和入职后的继续教育进行了深入分析和一条龙式的总体规划,阐明合格法律人才的培养和选拔不仅要注重知识,更要注重技能,这样才能真正培养和筛选出合格的法律人才。

Unified Judicial Examination and the Education and Selection of Qualified Legal Talents

The education and selection of qualified lawyers is regarded as one of the basis of the construction of rule of law inChina,but either the legal education or the national judicial exam,or the legal practical training,or the continued legal training,considered individually or as a whole,are not satisfying.This article deplores the national judicial exam systematically based on the statistics from the department of law of Wuhan City;at the same time,it tries to build the system of legal education and qualified lawyer selection as a whole by connecting the above institutions together.Such idea is emphasized that this system should not teach or test legal knowledge only but intellectual skills as well.
